Options and National Discretions
The Capital Requirements Regulation (EU) No. 575/2013 (CRR, as amended) and Directive 2013/36/EU (CRD, as amended) contain a number of national discretions and options which may be applied on the basis of national circumstances.
Per the 2010 CEBS (EBA) Guidelines on Supervisory Disclosures, ‘Option’ and ‘National Discretion’ have been defined as the following:
- Option refers to a situation in which competent authorities or Member States are given a choice on how to comply with a given provision, selecting from a range of alternatives set forth in Community legislation
- Discretion or national discretion refers to a situation in which competent authorities or Member States are given a choice as to whether to apply, or not to apply, a given provision
